TERMS OF USE

1. INTRODUCTION

These Terms of Use (“Terms”) govern your use of the Hmong AI mobile application (“App”) operated by Hmoob Brand LLC (“we”, “us”). By accessing or using the App, you agree to these Terms. If you do not agree, please refrain from using the App.

We reserve the right to modify these Terms at any time, with notice provided via email or in-app notification for material changes. Continued use of the App constitutes acceptance of any changes.

Please also review our Privacy Policy to understand how we collect, use, and protect your data.

2. ELIGIBILITY

You must be at least 18 years old to use the App. By using the App, you confirm that you are over 18.

3. ACCOUNT REGISTRATION

You must create an account to access certain features (like posting, commenting, or synchronizing credits across devices). You may use the App as a guest to view content and generate one free image.

You agree to provide accurate, current, and complete information (using real or pseudonymous names). You are responsible for maintaining the security of your account and for any activity that occurs under your account.

4. USE OF THE SERVICE

You may use the App to create, view, share, and sell images. You agree not to:

• Violate any applicable laws.

• Upload content that infringes on intellectual property or privacy rights.

• Harass, threaten, or defame others.

• Introduce viruses or malicious code.

• Interfere with the security or integrity of the App.

• Use automated programs to attack the server or generate images beyond your allowed credits.

5. CREDITS AND PAYMENTS

We use in-app purchases (IAP) to sell credits. Each generated image costs 5 credits. Credits do not expire but are used up once an image is generated.

All payments are processed via Apple’s in-app purchase system.

No Refunds: Purchases of credits are final and non-refundable. However, if you experience a technical error that prevents you from receiving the credits or using them (e.g., payment processed but credits not credited to your account), please email us at hmoobstore@gmail.com with the subject line “Refund Request” and a description of the issue. We may offer a manual refund at our sole discretion if the error is confirmed.

6. USER-GENERATED CONTENT & COMMERCIAL USE

You retain ownership of any images you generate. You grant us a non-exclusive, royalty-free license to use, display, and distribute your public content within the App to improve our services (e.g., in-app galleries, marketing).

You may use the images you generate for commercial purposes without attribution to us.

You are responsible for ensuring you have the necessary rights to any content you upload or share.

7. PRIVACY

We only collect limited personal information (such as your email address) for account creation and credit synchronization. We do not collect or process any sensitive data (e.g., health, financial, or biometric information). See our Privacy Policy for more details.

8. INTELLECTUAL PROPERTY

All rights in the App, including AI technology, design, and code, are owned by Hmoob Brand LLC. You are granted a limited, non-transferable license to use the App in accordance with these Terms.

9. DISCLAIMER AND LIMITATION OF LIABILITY

The App and generated images are provided “as is” without warranties of any kind.

We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App or generated content.

10. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in Minnesota, except that either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.

You waive any right to participate in class action lawsuits or class-wide arbitration.

COMMUNITY GUIDELINES

1. ZERO TOLERANCE POLICY

Strictly prohibited content includes:

• Harassment, bullying, threats, or intimidation

• Hate speech, discrimination, or content targeting individuals/groups

• Adult content, sexually explicit, or pornographic material

• Violence, gore, or content promoting dangerous activities

• Spam, scams, misleading information, or impersonation

• Copyright infringement or unauthorized use of others’ work

• Illegal activities or content promoting illegal behavior

• Content that promotes self-harm or eating disorders

2. USER RESPONSIBILITIES

You agree to:

• Treat all community members with respect

• Only share content you have the legal right to post

• Report inappropriate content when you see it

• Not engage in abusive or disruptive behavior

• Respect intellectual property rights of others

• Follow all applicable laws and regulations

• Help maintain a positive, creative environment

3. CONTENT MODERATION & SAFETY

• All user reports are reviewed within 24 hours

• Inappropriate content is removed immediately upon verification

• Users who violate guidelines face immediate account suspension

• Automated systems and human reviewers keep the community safe

• Repeat offenders are permanently banned

• We cooperate with law enforcement if necessary

4. REPORTING & SAFETY TOOLS

• Report Button: Tap (⋯) on any content to report it

• Block Users: Block anyone you don’t want to see

• Content Filtering: Automated detection of inappropriate content

• Quick Response: All reports investigated within 24 hours

• Anonymous Reporting: Your identity is protected

5. CONSEQUENCES OF VIOLATIONS

Violations result in:

• Immediate removal of offending content

• Warning notifications

• Temporary account suspension

• Permanent ban for serious or repeat violations

• Loss of all account data and generated content

• Reporting to authorities if needed

6. CONTENT OWNERSHIP & RIGHTS

• You retain ownership of content you create

• By making content public, you grant HmongAI permission to use it for app improvement and marketing

• You are responsible for having rights to any shared content

• We reserve the right to remove violating content

7. AGE REQUIREMENTS

You must be at least 18 years old to use HmongAI.
